By accessing or using our website, evaluation programs, trading services, or any other content provided by ONYX, you agree to be bound by these Terms and Conditions (“Terms”). Eligibility & Registration

By using our services, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction), have the legal capacity to enter into these Terms, and are not prohibited from accessing or using our services under any applicable laws or regulations. You are responsible for maintaining the confidentiality of your account credentials and all activities conducted under your account.

Services Provided

ONYX provides simulated trading evaluations and, upon successful completion, may grant traders access to a funded trading account (“PRO Account”) subject to applicable conditions. We are not a broker-dealer, investment adviser, or investment firm. We do not execute, clear, or custody trades on behalf of clients. Our services are limited to providing access to a trading evaluation program and potential simulated capital allocation.

Fees & Payments

Certain services require payment of fees. By enrolling in an evaluation or related service, you agree to pay all applicable fees as disclosed on our website. Unless otherwise required by law or expressly stated by ONYX, all fees are non-refundable.

Intellectual Property

All content, logos, trademarks, trade names, software, and proprietary materials provided on our website or platforms are owned or licensed by ONYX and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes only.

Prohibited Conduct

You agree not to violate laws, manipulate or attempt to manipulate simulated trading systems, exploit software vulnerabilities, or otherwise interfere with the integrity of our services. Unauthorized use may result in termination, forfeiture of fees, and potential legal action.

Termination

We may suspend or terminate access at any time, without notice, for violations of these Terms, unlawful conduct, or actions deemed harmful to our platform or users.

Limitation of Liability

To the fullest extent permitted by law, ONYX disclaims liability for any damages, direct or indirect, arising from your use of our services, including financial losses, lost profits, or system errors. All services are provided “as is” without warranty of any kind.

Amendments

Program Branding

Onyx Evaluation™ and Onyx Funded Accounts™ are proprietary programs assessing trader skill under simulated conditions. We are not a broker, clearing firm, or investment company. Participation does not create employment, partnership, or fiduciary relationships.

4. Risk Disclosures

Trading commodity futures involves substantial risk of loss and is not appropriate for every investor. The value of futures contracts may fluctuate and clients may lose more than their original investment. Leverage can amplify gains and losses.
